Buying a car or vehicle is difficult and stressful. What is the condition of the car? Has it ever been wrecked? Am I paying a fair price? Have they misrepresented any financing terms? There are many reputable and honest dealers doing business in Texas today. However, there are also some very dishonest dealers who will do anything to make a buck. You need to talk to a lawyer who knows how to fight auto and car dealer fraud.

There are many ways an auto dealer commits fraud on consumers. Fraud can happen at almost any stage of the car sale.

Previous Damage: Car and Auto dealers are required to disclose any previous damage to a vehicle at the time of sale. Rebuilt wrecked cars that have a salvage title must be disclosed. Additionally, if a vehicle has been damaged due to a hurricane or flood it must also be disclosed.

Odometer Rollback: A car dealer will roll back an odometer in order to have the customer believe the car is worth more than it really is.

Yo-Yo Deal: A yo-yo deal is where a car dealer completes the deal then a few days or weeks later calls the customer to renegotiate the deal representing that the financing failed to go through.

Fraudulent Warranty: Car dealers will often try to sell additional warranties with the vehicle. They often misrepresent the coverage the warranty provides. Additionally, they will lie to the client and state that a warranty is required to obtain financing when it is not, because the dealer makes a kickback on selling the warranty.

Deceptive Financing: Many consumers finance their car through the auto dealer finance department. Unfortunately, the dealer does not always offer the best interest rate or other terms for the client.

Failure to Pay Off Trade In: Many consumers will trade in their current vehicle for a new one. The dealer will account for the value of the trade in and is obligated to pay that off. Many dealers keep the money and do not pay in the trade in, leaving the customer on the hook for two vehicles - ruining their credit rating in the process.

Failure to Provide Copies of Sales Documents: The Truth in Lending Act requires that the car dealer provide complete copies of all documents at the time of sale. Several dealers will not provide you a complete copy stating they will put them in the mail. In the meantime, they forge and alter the documents from the original terms.

Repossession: Car dealers cannot use force to repossess a vehicle. They also must provide you specific notice of their intent to repossess. If they fail to comply with these requirements there are severe remedies.
